It seems niced processes can cause the CPU clock being increased regardless  
whether CONSIDER_NICE is set or not.

the issue is, that with CPUFREQ_CONTROL=kernel the meaning of CONSIDER_NICE is
inverted (the kernel setting is named "ignore_nice", but it has the same
semantics as our CONSIDER_NICE, i simply misread that).
I already located the error and will commit a fix to CVS.
Looks like another reason to do a YOU soon ;-)
