Installing modem - smartlink-softmodem missing

Configuring the modem IBM 82801DB/DBL/DBM (ICH4/ICH4-L/ICH4-M) AC97 Modem Controller YaST wants to install smartlink-softmodem (that's correct), but the package is missing (package source is a opensuse-mirror via http) I looked also on suse-mirror (SUSE-Linux10.0-Beta4-Extra), but not found
The package is not completely open source, perhaps it is not included in the opensuse because of that?

Ok, then yast on opensuse should not try to install it and could inform the user that the modem requires a closed source driver to work.
When it can't be included in the distribution, it would be nice when it is downloadable (like non-gpl kernel-modules or wlan-firmware), e.g. from ftp://ftp.suse.com/pub/suse/i386/10.0 or ftp://ftp.suse.com/pub/suse/i386/update/10.0/ (I haven't found it there, and the package from suse9.3 seems not to work)
It will be in the nongpl kernel module, we just disabled it for RC1 - and it's broken on Beta4.
